Resumen
Al hilo de tres libros publicados por el Prof. de Georgetown Mark
Tushnet, el artículo hace un repaso de las principales y más recientes tendencias
doctrinales, legislativas y jurisprudenciales en el Derecho constitucional
de los Estados Unidos de América. Se analizan particularmente
los efectos que sobre los derechos fundamentales ha tenido la legislación
antiterrorista (USA Patriot Act), así como, más en general, la orientación
conservadora seguida por el Tribunal Supremo en la última etapa de la
presidencia de Rehnquist. El artículo intenta dar algunas de las claves
que van a presidir el próximo relevo de algunos de los jueces de dicho
Tribunal.

Abstract
The article is a comment on three books published by Georgetown Professor
Mark Tushnet, and also an intent to describe the main contemporary
issues on American constitutional law (among the authors, in the Supreme
Court and in the Congress-made law). It focuses on the effects of the anti-terrorism
acts passed by the Congress since 2001 (particularly the USA Patriot
Act). The conservative shift in the Supreme Court (the Rehnquist Court) is
also analyzed. Finally, the author tries to clarify some of the aspects related
with the next vacancies in the Supreme Court.
